- Threshold has added to its traditional advice service for tenants by creating a specialist advocacy service to assist tenants at hearings of the Private Residential Tenancies Board.
Threshold has adapted to the new statutory framework established under the Residential Tenancies Act and the PRTB by developing its advocacy service.
Threshold advocates represent tenants at PRTB Tribunals and adjudications.
Research carried out by Threshold shows that tenants fare better with Threshold representation than when they attend hearings unrepresented. This has been highlighted in financial compensation awarded by the PRTB to tenants who have been illegally evicted. It also arises in cases where the jurisdiction of the PRTB to hear the case is challenged.
Threshold has also noted that landlords are often legally represented, in particular at Tribunal hearings. Threshold seeks to redress this balance.
- Threshold has designated specialist advocacy workers in each of its regional offices.
- It appointed a legal adviser - a barrister - to assist it in developing its advocacy work.
- Threshold also provides on-going training to advocates, provided by the legal adviser and practicing barristers engaged in a training role.
- Threshold will subject its performance at PRTB hearings to external quality control.
Threshold has prepared a 'PRTB handbook' to assist in its work at the PRTB. This includes criteria Threshold uses to decide if it will represent a client at a case. It also contains the obligations which arise for Threshold and the client when Threshold advocates for a client at the PRTB.
Threshold has also appointed a new member of staff to deal with queries from tenants from the EU10 Accession States. This person speaks fluent Polish and is available to members of the public.
As part of its developing advocacy service, Threshold refers landlords and agents to its website for information. It asks that third parties - such as Citizen Information Centres and other NGOs - to formally refer cases to it.
